Terms of Service
Last updated: October 12, 2026
These Terms of Service (“Terms”) govern your use of thedigiguys.com and your purchase of services from The Digital Guys (“TDG,” “we,” “us”). By using the site or buying our services, you agree to these Terms.
1. Our services
We provide performance marketing, automation, custom software and related services. Descriptions on this site are general. The scope, deliverables, timeline and fees for your engagement are set out in your proposal, statement of work, or order confirmation (your “Order”). If your Order conflicts with these Terms, your Order controls.
2. Payment and subscriptions
- Prices are in U.S. dollars and do not include applicable taxes.
- Monthly plans are billed in advance through Stripe and renew automatically each month until cancelled. By subscribing, you authorize us to charge your payment method on each renewal.
- You can cancel a monthly plan by emailing [email protected]. Unless your Order says otherwise, cancellation takes effect at the end of the current billing period.
- Except as stated in your Order or required by law, fees already paid are non-refundable.
- Advertising spend paid to third-party platforms (such as Google, LinkedIn or Meta) is separate from our fees unless your Order says otherwise.
3. Your responsibilities
You agree to give us accurate information, timely access to the accounts and materials we need, and prompt feedback. You are responsible for your products, offers and content, and for making sure they comply with applicable laws and the policies of the platforms we use for you. You confirm you have the rights to any materials you give us.
4. No guaranteed results
Marketing and software outcomes depend on many factors outside our control, including platform algorithms, competition, budgets and your own operations. Unless your Order expressly says otherwise, we do not guarantee any specific leads, sales, rankings, return on ad spend or other result.
5. Third-party platforms
Our work often relies on third-party platforms and tools. We are not responsible for their availability, policy changes, account decisions or fees.
6. Intellectual property
Unless your Order says otherwise, once you have paid in full you own the deliverables we create specifically for you. We keep ownership of our pre-existing tools, code, templates and know-how, and grant you a non-exclusive license to use any of them that are built into your deliverables. All content on this site belongs to TDG.
7. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only to perform or receive the services.
8. Disclaimers
The site and its content are provided “as is” for general information. Except as expressly stated in your Order, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, TDG will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the services or these Terms will not exceed the fees you paid us in the three (3) months before the event giving rise to the claim.
10. Indemnity
You will defend and indemnify TDG against third-party claims arising from your content, products or offers, or from your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York have exclusive jurisdiction over any dispute.
12. Changes
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Continuing to use the site or services after a change means you accept the updated Terms.
